General Terms and Conditions of Sale

ARTICLE 1. PREAMBLE

Any use of the premises of the company "Pixel Production" or its annexes implies the formal and unconditional acceptance by the client or any person representing them of these general terms and conditions of sale. The client declares having received and read them. It is understood that the client's acceptance of a quote, the placement of a dated and signed order, the payment of a deposit, or the commencement of any service implies acceptance of these terms and conditions.

ARTICLE 2. RENTAL CONDITIONS AND OPERATION OF THE PREMISES

The client agrees to provide the company "Pixel Production" prior to each service with a call sheet stating the names and roles of the people present on the rented set.
Consequently, these individuals will be deemed authorized by the Client to incur any expenses with Pixel Production. However, the Client may formally designate a single person to Pixel Production to incur expenses on their behalf. In the absence of a specific authorization or designated individual, all persons present on set will be considered authorized by the Client.

Any service performed by the company "Pixel Production" results in the creation by the set assistant of a set sheet detailing the equipment and services requested by the Client.
This production sheet will be submitted for approval by the Client or one of their representatives, who will receive a copy. The production sheet serves as the basis for invoicing. No subsequent disputes will be accepted by Pixel Production.
Furthermore, for each service, an expense report will be completed by the production assistant and signed by the Client. This report will document the expenses incurred by Pixel Production on behalf of the Client. These expenses will be increased by 100% on the final invoice for the service.

It is expressly agreed and accepted by the Client that our studios are billed by the day for a duration of 8 hours, from 10am to 6pm. Before 10am and after 6pm, the time spent will be billed as overtime, in 30-minute increments. In accordance with the collective agreement "for technical companies serving creation and events" applicable to the staff of the company "Pixel Production", any service lasting more than 8 hours must be scheduled at least 2 hours in advance and be the subject of a specific order form.

All our quotes are valid for 7 days and become invalid if they are not returned signed and stamped with the words "approved" within 7 days before the start date of the service. Any order cancelled less than 9 days before the start of the service will be invoiced in full.

Any equipment or accessories not collected within 48 hours of the service completion will incur a daily storage fee payable by the Client, calculated based on the stored volume. Items not collected by the Client within 7 calendar days will be disposed of and will be subject to an additional charge.

For security reasons, please note that the Client is responsible for the couriers they use. Therefore, the Client agrees to personally drop off and receive their packages at reception, as couriers are not authorized to circulate within the company premises.
In the absence of the Client, the visa affixed by the company "Pixel Production" on the letters or delivery slips does not engage its responsibility and has the sole purpose of confirming the passage of the delivery men in relation to their house and does not in any way constitute receipt, nor acceptance of the goods.

ARTICLE 3. RECOURSE, LIABILITY AND INSURANCE

The company "Pixel Production" undertakes to provide the Client with premises, equipment and materials in perfect working order.

The Client agrees to return them in the same condition. Otherwise, repair and refurbishment costs will be charged to the Client.

Our equipment is rented with insurance included, with a €150 deductible in case of an accident. This insurance does not cover theft. The customer is responsible for obtaining their own theft insurance.

The Client is responsible for all persons present at the location of the service and the consequences of their actions.

The Client agrees to take all necessary security measures for any valuable goods brought onto the premises of "Pixel Production". The Client agrees to inform "Pixel Production" of any such measures in advance.

The company “Pixel Production” cannot be held responsible for any bodily injury, material and immaterial damage occurring on the premises as well as any theft, deterioration or damage of any kind that may occur to cash, equipment, clothing or any other property, including animals, brought or brought by the Client, his representative or his agents.

Consequently, it is the Client's responsibility to take out the necessary insurance to cover all the aforementioned risks. The Client agrees to provide the corresponding certificate upon first request from Pixel Production.

ARTICLE 4. DIGITAL FILES AND SERVICES

The company “Pixel Production” cannot be held responsible for the loss or deterioration of images or computer data used by the Client or obtained through equipment made available to them.

In the event of any fault attributable to the company "Pixel Production", its liability cannot be engaged beyond the provision of the same technical means which were made available to the Client, to enable it to reconstruct the lost or damaged data.

ARTICLE 5. PAYMENT TERMS AND CONDITIONS

All services are payable as follows:

– 50% deposit upon order confirmation
– Balance, i.e. 50% on the day of service
– All options, i.e. 100% on the day of service

No discount will be given.

The Client agrees to be charged to the credit card he/she provided when making the reservation and paying the deposit.

Pixel Production reserves the right to include in its quotes an amount corresponding to a provision for catering and additional expenses, amounting to 10% of the total quote. It is understood that the corresponding invoice will only reflect the expenses actually incurred by the Client, as substantiated by the production schedule and expense report. Should the advance payments received exceed the invoice amount, Pixel Production undertakes to reimburse the difference within 15 calendar days.

If an invoice remains unpaid on its due date, late payment interest will automatically accrue, without prior notice, from the day following the due date, calculated on the outstanding amount at three times the French legal interest rate. Furthermore, all other invoices issued to the same Client, even those not yet due, will become immediately payable, as will all installments due on or after the due date related to one or more invoices.

The Client agrees to reimburse all costs and fees incurred in the legal recovery of sums due, including the costs, fees and/or emoluments of ministerial officers.

ARTICLE 6. DISPUTES

In the event of an incident or technical dispute, the client must record their observations on the platform sheet as defined in article 2.

In the event of a legal dispute, the Commercial Court of Paris shall have exclusive jurisdiction.
